We have received the “green light” from legal that we can send an annual  survey to our customers to ask if they would like to opt in to any communication, even if they have opted out of communication.

Right now, we sync the “Email Opt Out” to a field in SFDC to keep our various email systems in line.

If the Person “Email Opt Out” is marked yes, can they still receive operational emails? Based on the criteria, legal categorizes this an annual operational email.

Surveys are not considered operational emails - typically. If your legal team has qualified this particular survey (based on its nature) as operational, I would say go for it.

@gunjanm just to confirm though - if the “email opt out” is set to yes on the person record, will they still be able to receive the operational email?

I dont want them to fail in participants due to “universal opt out”

This one is ok annually bc it is about the communication they want to receive, vs us asking them how they feel about us. An annual communication on communication is allowed.
